strict scrutiny

a test used to ascertain whether a law violates a fundamental right granted under the U.S. Constitution. The government must show that although such a law treats some people favorably and others unfavorably, it is nevertheless the least inequitable way of handling an important issue. The test is often invoked in the context of discrimination based on race, gender, or nationality.
