State v. Mack

a case resulting in an influential 1980 Minnesota Supreme Court ruling that testimony based on memories uncovered during hypnosis, or after an eyewitness has undergone a hypnotic induction, is not admissible in court because hypnosis is an unreliable method of retrieving memories. This has been referred to as the per se exclusion rule. However, this rule banning hypnotically retrieved evidence does not apply to defendants. See Rock v. Arkansasrock-v-arkansas.

A number of other factors, such as environmental stimuli, may influence the process as well.
