restitutionary damages

a sum of money a defendant is ordered to pay the plaintiff in a civil lawsuit to negate a benefit the defendant obtained by acting improperly. For example, consider a person who exploits for personal profit land that he or she does not own. This person may be considered to have unjustly benefited at the landowner’s expense and thus may be ordered to pay restitutionary damages.
